Liquid DJs terms of service, refund policy and privacy policy
1. The Agreement with Liquid DJs constitute the entire agreement and understanding among the parties hereto with respect to the subject matter hereof and supersede all prior understanding and agreements, whether written or oral, with respect to the subject matter hereof. This Agreement may be amended only by a written instrument executed by the parties hereto.
2. Client does hereby agree, as a condition precedent to Liquid DJs Inc. performance hereunder, to provide: a. A minimum of one (1) six (6) foot long skirted table near a suitable electrical outlet if DJ booth has not been purchased as an upgrade; b. Access to the location of event at least two (2) hours before the event start time; c. Sufficient shelter in the event of adverse weather conditions (Outdoor Events Only) and; d. Meals for all Liquid DJs Inc. staff in attendance, if meals are being served.
3. This Agreement shall only become binding upon Liquid DJs Inc. receipt of payment of the full deposit within SEVEN (7) days of emailed contract. Prior to receipt of the confirmation of this Agreement, and payment of the full deposit, Liquid DJs Inc. is not under any obligation to hold the date of event open for the Client.
4. Upon receipt of full payment of the deposit, Liquid DJs Inc. will reserve the date of event for client, and shall not seek to plan other engagements for this time with their chosen entertainer (if specified). As such, unless otherwise specified herein, Liquid DJs Inc. shall RETAIN CLIENT'S DEPOSIT as a reasonable estimation of its damages hereunder if this Agreement is not performed for any reason, including, but not limited to, the following circumstances: a. The Client canceling this Agreement; b. The Client's failure to complete all the conditions precedent to Liquid DJs Inc. obligations, as specified in this Agreement; c. Liquid DJs Inc. inability to perform hereunder if its performance is impeded by matters outside of its control, including, but not limited to, fire, casualty, acts of God, local, state or federal regulations, inadequate crowd control or protection from environmental conditions.
5. In the event the Client cancels the Event, but requests Liquid DJs Inc. services for a different date (a "Rescheduled Date"), the parties shall enter into a new Agreement for the Rescheduled Date. Liquid DJs Inc. reserves the right to apply Client's previously paid deposit and balances to the Rescheduled Date, and Client agrees to pay any additional Retainer due at that time.
6. Liquid DJs Inc. recognizes specifying a DJ by name for Client's Event as contractual. Liquid DJs Inc. will do everything in its power to insure that the specified entertainer will appear on the Event date. If the DJ assigned to this Event is unable to perform due to illness, accident, equipment failure or otherwise, Liquid DJs Inc. shall use its best efforts to find a qualified replacement DJ, equipment or to otherwise perform hereunder. In the event, Liquid DJs Inc. is unable to locate a replacement DJ or replacement equipment, and therefore fails to perform hereunder, Client's deposit shall be refunded within the thirty (30) days following the Event. The parties agree that refund of its deposit shall be Client's sole and exclusive remedy in either law or in equity for Liquid DJs Inc. failure to perform hereunder.
7. Liquid DJs Inc. does not provide any warranties or guarantees with respect to its performance hereunder and none should be implied by Client, or by law.
8. The Client agrees to be fully responsible for any loss or damage suffered by Liquid DJs Inc. to its equipment, representatives or otherwise during the performance, including, but not limited to, damage as a result of improper crowd control, negligent or willful misconduct by the Client\'s guests or exposure to environmental elements.
9. If Client fails to pay the full amount due TEN (10) days prior to the Event, Liquid DJs Inc. reserves the right to cancel this event after notifying Client. In the event Liquid DJs Inc. must commence collection procedures for any reason, Client shall pay the costs and expenses of the same, including, but not limited to, reasonable attorneys fees and office hours spent.
10. Liquid DJs Inc. herein reserves the right to utilize photographs, video recordings, audio or other media documentation of the Event for purposes of its own marketing and the Client herein expressly authorizes any such activities by Liquid DJs Inc.
11. Liquid DJs Inc. reserves the right to renegotiate agreement if client chooses to participate in or have their event recorded for broadcast locally or nationally. Disclosure of intent to record for public broadcast must be made prior to agreement to Liquid DJs Inc. terms and conditions and payment of deposit, otherwise Client will be considered in "violation of agreement" and deposit will not be refunded.
12. This Agreement shall be construed in accordance with the laws of the State of Florida.
13. Gratuity is not included. Tipping is appropriate and appreciated.
14. Overtime amount will be automatically charged to the Client's credit card within 5 business days following the event unless the Client notifies Liquid DJs to use another payment method prior to the event.
15. There is a $45.00 Fee for All Returned Checks.
